1. BOOKING & ACCEPTANCE
A booking is considered confirmed once South Florida Surprises has approved the booking and the required deposit has been received. By submitting a deposit, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
South Florida Surprises reserves the right to decline a booking or service request at its discretion.
The Client is responsible for providing accurate event information, including the event date, start time, location, venue, parking instructions, point-of-contact information, and any other information necessary for South Florida Surprises to successfully provide the contracted services.
2. DEPOSIT AND FINAL PAYMENT
A deposit is due at the time of booking to reserve your date and character(s). The deposit is non-refundable under any circumstance, including Client cancellation or postponement, except where otherwise specifically stated in these Terms and Conditions.
The remaining balance is due no later than
72 hours before your event. You will receive a reminder email when your final payment is approaching.
To avoid losing your reserved booking, please submit your deposit as soon as possible after your booking is approved.

South Florida Surprises is not responsible for delays caused by payment processing, incorrect payment information, or payments sent to an incorrect account.
3. LATE PAYMENTS
If the final balance has not been received by the event date and the event proceeds, a late fee of $10 per day will apply beginning the day after the event until the balance is paid in full.
South Florida Surprises reserves the right to require payment in full before an event begins if the final balance has not been received by the stated due date.
4. TRAVEL AND PARKING
A travel fee applies to events held more than 15 miles from our Davie, Florida home base, with a minimum travel fee of $15 per performer. Any applicable travel fee will be listed on your invoice before your deposit is due.
South Florida Surprises is not responsible for on-site parking fees. If parking is not provided or prepaid, any parking costs incurred by our team will be invoiced to the Client after the event.
The Client is responsible for providing accurate parking, entrance, and access instructions when applicable.
5. PERFORMER ARRIVAL AND PERFORMANCE TIMEPlease allow a 10–15 minute arrival window for your entertainer. Our performers may travel between multiple events, and traffic, parking, venue access, or other unforeseen circumstances may occasionally affect arrival time.
If a delay is caused by South Florida Surprises, we will make every reasonable effort to provide the full contracted performance time or otherwise address the situation appropriately.
If a delay is caused by the Client, venue, guests, lack of access, or circumstances outside South Florida Surprises' control, the performance will still end at the originally scheduled time, and no refund or reduction will be provided.
If the Client or guests are not ready for the scheduled performance, the performer may wait when reasonably possible, but the performance time will not automatically be extended.
6. CLIENT AND VENUE RESPONSIBILITIES- The Client is responsible for:
- Providing a safe and reasonably appropriate performance area.
- Ensuring that the venue permits the contracted entertainment.
- Obtaining any required venue approvals, permits, reservations, or permissions unless otherwise agreed in writing.
- Providing accurate event and venue information.
- Ensuring the performer has reasonable access to the event location.
- Providing any required shelter for outdoor performances.
- Informing South Florida Surprises in advance of relevant venue restrictions or special circumstances.
- Ensuring that children and guests are appropriately supervised throughout the event.
South Florida Surprises entertainers are entertainers and are not babysitters, childcare providers, or responsible for supervising children.
7. CHILD SUPERVISION AND GUEST CONDUCTA parent, guardian, Client, or other responsible adult must remain responsible for the supervision and safety of children and guests throughout the event.
Guests are expected to treat South Florida Surprises performers, staff, costumes, equipment, and property respectfully.
The following behavior is not permitted:
- Hitting, kicking, pushing, grabbing, or otherwise physically harming a performer.
- Inappropriate or unwanted touching of performers.
- Threatening, intimidating, harassing, or abusive behavior.
- Deliberate damage to costumes, equipment, or property.
- Any behavior that creates an unsafe environment for the performer, Client, or guests.
If a performer is placed in an unsafe or inappropriate situation, South Florida Surprises may pause or end the performance without refund.
The Client is responsible for addressing inappropriate guest behavior when requested by the performer or South Florida Surprises representative.
8. PERFORMER SAFETYThe safety of our performers, Clients, guests, and equipment is a priority.
Performers may decline to participate in an activity or enter an area that they reasonably believe presents a safety risk.
South Florida Surprises may pause, modify, or end a performance if circumstances create an unsafe environment, including but not limited to dangerous weather, unsafe surfaces, aggressive animals, hazardous conditions, inappropriate guest behavior, or other safety concerns.
No refund or reduction will be provided when a performance is interrupted or ended because of unsafe conditions caused by the Client, venue, guests, or circumstances outside South Florida Surprises' reasonable control.
9. CANCELLATION AND POSTPONEMENTCancel or postpone 7+ days before your event:
Your deposit is forfeited and is non-refundable. Any additional payments already made toward your event will be refunded.
Cancel or postpone less than 7 days before your event:
The full event fee is due because it is unlikely that we will be able to rebook the reserved time slot on short notice. No refund will be issued. At the discretion of Administration, some or all of the amount paid may be offered as a credit toward a future event.
Postponements are subject to performer, character, and date availability. A postponement is not guaranteed to retain the same performer, character, time, or pricing.
10. EVENT CHANGESRequests to change the event date, time, location, duration, characters, package, services, or other booking details must be approved by South Florida Surprises.
Changes are subject to availability and may result in additional fees or a change in the total event price.
A change is not considered approved until confirmed by South Florida Surprises in writing.
Moving an event to a new date does not automatically waive the applicable cancellation or postponement policy.
11. WEATHER POLICYUnless otherwise noted on your invoice, bookings are rain or shine, and compensation is not automatically affected by weather.
For outdoor events, the Client is responsible for arranging appropriate overhead shelter for the performance area unless otherwise agreed upon in writing.
Performer and guest safety comes first. If weather poses a safety risk to the performer, guests, costumes, equipment, or other property, South Florida Surprises may pause, modify, relocate, or end the performance early.
Every reasonable effort will be made to continue the performance once conditions are safe.
If rain begins immediately before a character is scheduled to enter, sound equipment or other equipment may need to remain protected until conditions are safe. Because performers may be booked for additional events, South Florida Surprises may not be able to delay the start time or shift the performance schedule.
Refunds are not issued for weather-related interruptions when South Florida Surprises has made reasonable efforts to provide the contracted services.
12. NATURAL DISASTERS AND FORCE MAJEURESouth Florida Surprises is not responsible for circumstances beyond its reasonable control that prevent or significantly interfere with an event.
Such circumstances may include hurricanes, flooding, severe weather, natural disasters, government restrictions or orders, venue closures, road closures, widespread emergencies, major transportation disruptions, or other unforeseen events that make performance impossible or unsafe.
In the event of a hurricane or similar last-minute emergency, South Florida Surprises will work with the Client to apply payments toward a mutually agreed-upon rescheduled event when reasonably possible.
A full refund is not guaranteed in force majeure circumstances.
13. PERFORMER AND CHARACTER SUBSTITUTIONSSouth Florida Surprises makes every effort to provide the specific performer, character, costume, and services selected at booking.
However, circumstances including illness, injury, emergencies, costume damage, transportation issues, performer availability, or other unforeseen circumstances may occasionally require a substitution.
If a specific performer becomes unavailable, South Florida Surprises may provide another qualified performer.
If a specific character or costume becomes unavailable, South Florida Surprises may offer a comparable character or alternative entertainment option when reasonably possible.
If South Florida Surprises is unable to provide a contracted service due to an unforeseen circumstance, the Client will receive a refund or credit for the affected service that was not provided, as applicable.
14. EVENT DELAYSIf a delay to the performer's start time is caused by the Client, venue, guests, lack of access, or other circumstances within the Client's control, South Florida Surprises is not obligated to extend the performance beyond the original scheduled end time.
No refund or reduction will apply because of a Client- or venue-caused delay.
If South Florida Surprises causes a significant delay or is unable to complete the contracted performance due to circumstances within our control, we will make reasonable efforts to provide the contracted service or otherwise work with the Client to determine an appropriate adjustment.
Any agreed-upon fee reduction or refund must be confirmed in writing.
15. NO-SHOWS AND SERVICES NOT RENDEREDIf a performer is unable to arrive for an event due to an emergency or unforeseen circumstance and South Florida Surprises is unable to provide a replacement or otherwise fulfill the contracted service, the Client will receive a refund for the portion of the services that were not rendered.
For multi-performer or multi-service bookings, refunds will apply only to the affected service(s), rather than automatically to the entire booking.
South Florida Surprises will make reasonable efforts to provide a replacement performer or alternative solution whenever possible.
16. HEALTH, ALLERGIES, AND SPECIAL CONSIDERATIONSThe Client is responsible for informing South Florida Surprises in advance of any known allergies, sensitivities, medical considerations, mobility considerations, or other special circumstances that may affect the services being provided.
For activities such as face painting or temporary tattoos, the Client or parent/guardian is responsible for informing the performer of any known allergies or sensitivities before the product is applied.
Parents and guardians should make their own decisions regarding participation in any activity based on their child's individual needs.
South Florida Surprises cannot guarantee an allergen-free environment unless a specific arrangement has been made and confirmed in writing in advance.
17. PHOTOGRAPHY AND MEDIASouth Florida Surprises may photograph or record portions of events for internal documentation, quality assurance, or promotional purposes only when appropriate permissions have been obtained.
The Client understands that guests may independently photograph or record performers during an event and that South Florida Surprises does not control how third parties use such images or recordings.
18. LIABILITY AND ASSUMPTION OF RISKThe Client understands that entertainment activities may involve movement, dancing, games, interaction with characters, props, face painting, and other activities that carry ordinary and reasonable risks associated with participation.
The Client is responsible for supervising children and guests and for determining whether an activity is appropriate for them.
South Florida Surprises is not responsible for injuries, damages, losses, or incidents resulting from:
- Unsafe conditions created or maintained by the Client or venue.
- Guest or participant behavior.
- Failure to properly supervise children or guests.
- Activities undertaken by guests outside the direction or control of South Florida Surprises.
- Information or medical/allergy information not disclosed to South Florida Surprises.
- Conditions outside South Florida Surprises' reasonable control.
Nothing in these Terms and Conditions is intended to waive any rights or protections that cannot legally be waived under applicable law.
19. VENUE RESTRICTIONS AND ACCESSThe Client is responsible for confirming that the selected venue allows the contracted entertainment and for obtaining any required approvals.
If a venue refuses entry to a performer, restricts the contracted entertainment, or prevents the performance from taking place after the performer has arrived, the booking remains subject to the applicable payment and cancellation terms.
The Client should notify South Florida Surprises in advance of any special venue requirements, security procedures, parking restrictions, elevator access, loading procedures, or other circumstances that may affect the performer.
20. NON-SOLICITATION AND DIRECT HIRINGAll booking-related communication should remain between South Florida Surprises representatives and the Client's designated event point of contact.
Clients may not use information obtained through a South Florida Surprises booking to circumvent South Florida Surprises and independently hire, solicit, or engage a South Florida Surprises performer or staff member for substantially similar entertainment services.
This provision applies during and after the event.
Any separate performer or staff agreements governing direct hiring, solicitation, or outside work remain applicable where legally enforceable.
21. GRATUITYGratuity is never included in our pricing but is always appreciated. Cash tips for performers are welcome on-site. Clients may also Zelle a tip to:

Please include a note with the Zelle payment such as "character tip + event date."
22. DISPUTES AND GOVERNING LAWThese Terms and Conditions are governed by the laws of the State of Florida.
The parties agree to make a good-faith effort to resolve any dispute directly before pursuing formal legal action.
Nothing in these Terms and Conditions limits any rights or remedies available under applicable law.
23. ENTIRE AGREEMENTThese Terms and Conditions, together with the Client's invoice, booking confirmation, and any written agreements or modifications approved by South Florida Surprises, constitute the agreement between the Client and South Florida Surprises regarding the booked services.
Any changes to the agreed services or terms must be confirmed in writing by an authorized South Florida Surprises representative.
If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
24. ACKNOWLEDGMENT AND ACCEPTANCEBy approving a booking and submitting the required deposit, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
The Client further acknowledges that they are responsible for providing accurate event information and for communicating these terms to any other person acting on their behalf in connection with the event.
